QBR Terms and Conditions
1.1 These Terms and Conditions:
(a) apply to and govern the contractual relationship between Credabl Pty Ltd ACN 615 968 100 (Credabl) and each Member with respect to the Reward Scheme made available by Credabl as a participant in the Qantas Business Rewards Program;
(b) are effective as at the date specified above and may be amended from time to time; and
(c) operate in conjunction with the Qantas Business Rewards Program Terms and Conditions (available at www.qantasbusinessrewards.com) and in the event of any inconsistency or conflict the Qantas Business Rewards Program Terms and Conditions prevail.
1.2 The current Reward Scheme Terms and Conditions are available at http://www.credabl.com.au/qbr/terms-and-conditions It is the Member’s responsibility to read and understand them. Any queries regarding these Terms and Conditions should be directed to Credabl.
2. Definitions and interpretation
2.1 Unless the context otherwise requires:
(a) terms used in the Qantas Business Rewards Program Terms and Conditions and the QFF Program Terms have the same meaning in these Terms and Conditions; and
(b) the following terms have these meanings in these Terms and Conditions:
Eligible Products means commercial equipment finance leasing, commercial asset finance and commercial loans obtained directly through Credabl. Any consumer financial products are not Eligible Products.
Eligible Transaction means a transaction between Credabl and the Member in relation to Eligible Products only.
Member a Qantas Business Rewards Member that is entitled to participate in an Eligible Transaction.
Membership Account means the membership account that a Qantas Business Rewards Member has in the Qantas Business Rewards program.
Qantas means Qantas Airways Limited ABN 16 009 661 901.
Qantas Business Rewards means the loyalty program described on the website www.qantasbusinessrewards.com (also accessible by qantas.com/business) and known as Qantas Business Rewards, or any replacement program.
Qantas Business Rewards Benefits means a benefit available under the Reward Scheme and includes Qantas Points.
Qantas Business Rewards Member means an ABN holder who is registered as a member of the Qantas Business Rewards Program.
Qantas Business Rewards Program means the business rewards program operated by Qantas which is currently known as Qantas Business Rewards.
Qantas Business Rewards Terms and Conditions has the meaning given to it in clause 3.1.
Qantas Points means the loyalty points that are offered to Qantas Business Rewards Members for Eligible Transactions in accordance with the Qantas Business Rewards Program Terms and these Terms and Conditions.
Reward Scheme means the Credabl Qantas Business Rewards scheme which is operated by Credabl in accordance with these Terms and Conditions.
Terms and Conditions means these Reward Scheme Terms and Conditions which are administered by Credabl.
“we or us” means Credabl Pty Limited ACN 615 968 100 and any related body corporate (as that term is defined in the Corporations Act 2001 (Cth).
“you” means, you, a Member.
2.1 In these Terms and Conditions, unless the contrary intention appears:
(a) all references to dollars are to Australian dollars;
(b) the singular includes the plural and vice versa; and
(c) a reference to ‘include’ or ‘including’ means ‘including but not limited to.
3. Application of Reward Scheme Terms and Conditions
3.1 By claiming any Qantas Business Rewards Benefit under the Reward Scheme, a Member agrees to be bound by these Terms and Conditions in addition to the Qantas Business Rewards Program Terms and Conditions (www.qantasbusinessrewards.com).
3.2 These Terms and Conditions and the Qantas Business Rewards Program Terms and Conditions are in addition to any terms and conditions applicable to any Eligible Products and Eligible Transactions.
4. Changes to Reward Scheme
4.1 Subject to clause 4.2 and the Qantas Business Reward Program Terms and Conditions, Credabl may implement any changes (whether material or otherwise) to these Terms and Conditions and the Qantas Points offered in relation to Eligible Products and Eligible Transactions, including changes to:
(a) the ways in which Qantas Points are earned under the Reward Scheme;
(b) Eligible Products; and
(c) restrictions, conditions and eligibility to earn Qantas Points under the Reward Scheme.
4.2 Credabl will inform Members of any material changes to these Terms and Conditions and where such changes will reduce the number of Qantas Points offered to Members under the Reward Scheme, when possible, give Members at least 30 days’ notice.
4.3 Without limiting clause 4.1 in any way, Members will be taken to have received the notice referred to in clause 4.2 if Credabl or Qantas Business Rewards notifies Members of the change by sending an email to the email address provided by the Member to Credabl. It is the responsibility of the Member to keep Credabl notified of any changes to its email address.
5. Termination or suspension of the Reward Scheme
5.1 Credabl gives no undertaking or assurances as to the continuing availability of the Reward Scheme. Credabl may terminate or suspend the Reward Scheme at any time. Credabl will give at least 30 days’ notice to Members of such termination or suspension, except if the Qantas Business Rewards Program ceases to operate, in which case the Reward Scheme will cease immediately.
5.2 If Credabl terminates or suspends the Reward Scheme, subject to the Qantas Business Rewards Program Terms and Conditions, Members will be able to transfer Qantas Points during the notice period, except where:
(a) Qantas is ceasing to operate an airline business and/or has gone into liquidation, receivership or other form of administration; and/or
(b) Credabl ceases to operate its business and/or has gone into liquidation, receivership or other form of administration,
in which case Qantas Points in the Qantas Business Rewards Program may be cancelled without notice.
6. Earning Qantas Business Rewards Benefits
6.1 Subject to the exclusions, limitations and other conditions specified in this clause 6 and these Terms and Conditions, Credabl will allocate 1 Qantas Point for each whole AUD1.00 of the total value of an Eligible Product made in Australia (inclusive of GST and rounded up or down to the nearest whole dollar value of the Eligible Transaction.
6.2 No Qantas Business Rewards Benefits will be awarded if the Eligible Product or Eligible Transaction is cancelled, refunded or returned.
6.3 Members are not entitled to claim Qantas Business Rewards Benefits under the Reward Scheme for:
(a) consumer lending products; or
(d) in conjunction with any other offers by Credabl.
6.4 To earn Qantas Business Rewards Benefits in relation to an Eligible Product, the Member must quote its ABN and at the time of purchasing an Eligible Product and must comply with any other requirements or procedures advised by Credabl prior to the purchase.
6.5 It is the responsibility of the Member to check whether a product or other activity is eligible to earn Qantas Business Rewards Benefits, and if so how many Qantas Points or which other Qantas Business Rewards Benefits will be earned, before making a purchase or undertaking the relevant activity.
6.6 Members must provide Credabl on request with documented verification of the purchase of an Eligible Product. Credabl reserves the right to deny or revoke the crediting of Qantas Points in the Qantas Business Rewards Program at any time if Credabl determines that Qantas Points were improperly obtained or erroneously credited to a Member’s Membership Account.
6.7 Unless otherwise determined by Credabl, Members are not eligible to earn Qantas Points in the Reward Scheme if they have their principal place of business outside Australia or the Eligible Transaction is not for business purposes.
6.8 Credabl may offer additional opportunities to earn Qantas Points in the Qantas Business Rewards Program under a special promotion from time to time, in which case the terms and conditions referred to in the promotion will apply.
7. Crediting Qantas Points in Qantas Business Rewards
7.1 Credabl will endeavour to instruct Qantas Business Rewards to credit the applicable number of Qantas Points to the Membership Account within 45 days after the purchase of an Eligible Product. It is the responsibility of the Member to check that the correct number of Qantas Points has accumulated in the Membership Account.
7.2 Claims for the crediting of Qantas Points in Qantas Business Rewards retrospectively must be made by the Member to Credabl within 90 days after the purchase of an Eligible Product. Unless otherwise specified by Qantas Business Rewards, claims for the crediting of Qantas Points cannot be made if the customer has ceased to be a Member at the time of the claim or if the account of the Member was not active at the time the Eligible Product was purchased.
7.3 Any disputes for missing Qantas Points will only be considered if notified to Credabl within 3 months of the date of the relevant transaction and supporting evidence is provided.
8. Suspension or termination of a Member or Qantas Points in Qantas Business Rewards
8.1 Credabl reserves the right to terminate a Member’s participation in the Reward Scheme or withhold or cancel Qantas Points claimed under the Reward Scheme if a Member or any of the Member’s representatives has attempted to claim Qantas Points under the Reward Scheme to which they were not entitled.
8.2 Credabl and Qantas Business Rewards will not be liable for any loss or damage whatsoever suffered by any person as a result of such withholding or cancellation and the Member is responsible for ensuring that the recipients of its nominated Qantas Points are notified of this. If Credabl terminates the Reward Scheme or cancel your participation in the Reward Scheme, any Qantas Points that have not been credited to your Qantas Business Rewards account at that time are forfeited.
9. Personal Information
9.2 All complaints regarding Qantas Points or the Terms and Conditions will be resolved by Credabl in accordance with our complaints handling process.
10. Taxation Implications
The accumulation of Qantas Points may incur taxes for which the Qantas Business Rewards Member and/or Qantas Frequent Flyer member may be liable. We recommend you consult your accountant or tax adviser to ensure you understand possible tax implications, for example fringe benefits tax (if applicable). Redemption of Qantas Points for flights and other rewards may incur taxes, fees, levies and charges even where no ticket fare or other acquisition cost is applicable, and it is the responsibility of the Qantas Business Rewards and/or Qantas Frequent Flyer Member to pay these costs.
11. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place.
^Classic Flight Rewards are available on Qantas, Jetstar and partner airlines. Seats are subject to capacity controls, availability is limited, and some flights may not have any Classic Flight Rewards available. Taxes, fees and carrier charges are payable to Qantas (excluding any amounts payable to third parties at the airport) in addition to the points required. Status Credits and Qantas Points will not be earned on Classic Flight Rewards. For more information about Classic Flight Rewards visit the Qantas website.
2019 ADIA Queensland conference offer
The 30,000 bonus Qantas Points offer is only available on asset finance obtained directly through Credabl. Only clients who registered at the 2019 ADIA Queensland conference are eligible. For Applications settled between 11 October 2019 and 10 December 2019 until 11.59pm AEST. Not available for any consumer lending products or in conjunction with any other offers. Qantas Points will be credited within 45 days of finance being provided. Any claims in relation to Qantas Points under this offer must be made directly to Credabl by calling 1300 27 33 22 or emailing firstname.lastname@example.org.
